The data protection “Code” came into force on 1 January 2004, establishing new measures for citizens and bringing together all the various laws, codes and regulations relating to data protection.
The “Code” guarantees that data processing is carried out respecting the person’s rights, fundamental liberties and dignity, and in particular his or her privacy, personal identity and right to personal data protection. (art. 2, cl. 1).

La Fralluca considers worthwhile to define some fundamental concepts:
Personal data
Any information relating to a natural or legal person, a company or association, that can be even indirectly identified or identifiable through any other information, including a personal identification number.
Identification data
Personal data allowing the person’s direct identification .
Sensitive data
All the data revealing the person’ s race and ethnic origin, religious, philosophical or other beliefs, political opinion, membership of political parties, trade unions, associations or organization of religious, philosophical, political or trade union, as well as data disclosing health and sex life.
Owner
A natural or legal person, local administration and any other board, association or body which, even in collaboration with any other owner , are entrusted with decisions with the purposes and modes of treatment of personal data and tools to be used, including safety profile.
Responsible
A natural or legal person, local administration and any other board, association or body entrusted by the owner to process personal data.
Officer
A natural person authorized by the owner and the responsible to process personal data.
Person concerned
The natural or legal person, the board or association the personal data are related to.
Personal data processing
Any operation or series of operations even performed without the aid of electronic means concerning the collection, recording, collection, recording, organization, conservation, consultation, elaboration, modification, selection, extraction, comparison, use, interconnection, freezing, communication, disclosure, deletion and destruction of data, even if not recorded in a database.
Conferring personal data is entirely optional, but it is necessary to the agreement fulfillment , failure to supply them shall hinder the possibility for our company to provide the service. Moreover, personal data may be disclosed to the police or judicial authority to fulfill and respect legal obligations, legislations and current Community legislation. Conferring the personal data required for these purposes is compulsory.
Personal data shall also be processed for marketing and advertising promotion, public relation or market surveys purposes. Conferring such data is optional.
Filling in the fields with personal data on the WEB is entirely voluntary but compulsory for the correct registration on the website..
The data are processed by manual, electronic and/or automated tools, with logic related to the aforementioned purposes, and in any case, to ensure the security and confidentiality of the data.
Amongst the conferred data there may be some of them which the Code defines as “sensitive” (e.g. disabled person, person affected by food problems), these data can only be processed with the person’s express written consent, failure to provide such consent will cause the impossibility for La Fralluca to fulfill its contractual obligations.
Such data can also be disclosed upon specific request to tax, law and business consultants, as well as to credit institutes and credit recovery to fulfill the applicable laws and legislation or for credit protection purposes.
Categories of third party entities to wich the data may be communicated in their role as Data controllers are the following: La Fralluca employees, managers, partners and promoters, temporary worker, apprentices and Legal Department employees.
The data will not be disclosed.
The law gives to the person concerned specific rights, as set out in art. 7 of Italian Legislative Decree no. 196 of 30 June 2003, among which the right to obtain erasure, conversion in anonymous form, the blocking of data held in violation of the law, as well as the updating, rectification or, if it is the case, integration of data and to oppose for legitimate reasons to the processing.
In closing, the person concerned can in any moment oppose to the data processing aimed at commercial and marketing information, direct sales or market surveys.
